These Terms of Service govern your access to and use of Clustra's website, applications, and services.

By using Clustra, you agree to these Terms.

If you do not agree, do not use the Service.

You must be at least 13 years old to use Clustra.

If you are using Clustra on behalf of an organization, you represent that you have authority to bind that organization.

You are responsible for maintaining account security, protecting login credentials, and activities occurring under your account.

You agree to provide accurate and up-to-date information when creating and maintaining your account.

Clustra provides services including automatic file organization, intelligent document indexing, AI-powered search, knowledge retrieval, meeting transcription, report generation, context-aware document assistance, productivity and workflow tools, and optional synchronization features.

Clustra is designed with a privacy-first architecture. File analysis, indexing, search, transcription, and AI processing are performed locally on your device whenever possible. Your files, documents, recordings, and generated knowledge remain on your device and are not transmitted to Clustra's servers as part of normal platform operation.

Clustra may process limited account-related information, subscription information, and synchronization metadata necessary to provide account management, billing, licensing, and optional synchronization services.

Features may change over time.

You retain all ownership rights to your files, documents, recordings, notes, and other content processed through Clustra.

Because Clustra primarily operates locally on your device, your content is generally not uploaded to or stored on Clustra's servers.

By using Clustra, you grant Clustra a limited license solely to operate the application, process content locally on your device, provide requested features and functionality, manage account-related services, and facilitate optional synchronization features you choose to enable.

Clustra does not claim ownership of your content.

Any limited rights granted under this section exist only to the extent necessary to provide the Service and end when you stop using the Service or delete your content, except where retention is required by law.

You agree not to violate applicable laws or regulations, upload or distribute malicious software, attempt unauthorized access to systems or accounts, reverse engineer, copy, or exploit the platform except as permitted by law, interfere with service operations, use Clustra for unlawful, fraudulent, or harmful activities, abuse AI features, or attempt to circumvent platform safeguards.

Clustra may suspend or terminate accounts that violate these Terms.

Clustra's AI features may generate summaries, reports, recommendations, search results, meeting notes, and organizational suggestions.

AI-generated outputs are provided for informational and productivity purposes only.

While Clustra strives to provide useful results, AI-generated outputs may contain inaccuracies, omissions, or errors.

Users remain solely responsible for reviewing and validating outputs before relying on them for personal, business, legal, financial, medical, or professional decisions.

Certain features require paid subscriptions.

Subscription fees are billed in advance.

Unless otherwise stated, fees are non-refundable, plans renew automatically until canceled, and users may cancel future renewals at any time.

Subscription services may include account management, licensing, synchronization capabilities, and other premium features.

Pricing may change with reasonable notice.

Clustra and its technology, software, branding, designs, trademarks, and related materials are owned by Clustra and protected by applicable intellectual property laws.

These Terms do not grant users any ownership rights in Clustra's intellectual property.

Users retain ownership of their own content and data.

We strive to maintain reliable services but do not guarantee uninterrupted availability.

We may modify features, suspend services, conduct maintenance, remove functionality, or update software components at our discretion.

Because many Clustra features operate locally on your device, certain functionality may remain available even when Clustra's online services are unavailable.

Clustra is provided on an "AS IS" and "AS AVAILABLE" basis.

To the fullest extent permitted by law, Clustra disclaims all warranties, whether express, implied, or statutory, including warranties relating to accuracy, availability, reliability, performance, merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, Clustra shall not be liable for indirect damages, incidental damages, consequential damages, lost profits, lost business opportunities, data loss, or business interruption.

Clustra's total liability arising out of or relating to the Service shall not exceed the amount paid by the user to Clustra during the twelve (12) months preceding the event giving rise to the claim.

We may suspend or terminate access if these Terms are violated, accounts are abused, fraudulent activity is detected, termination is required by law, or continued access poses security or operational risks.

Users may terminate their accounts at any time.

Termination does not affect obligations or rights that accrued before termination.

These Terms shall be governed by and construed in accordance with the laws of the Republic of Ghana, without regard to conflict of law principles.
